Terms and condition (Provider)

These terms govern your use of the Next Roadside marketplace, dispatch platform and mobile app, including the relationship between drivers and the independent providers who accept their requests.

1. Provider Eligibility & Credentials

  • Service providers must hold active, valid business licenses, commercial driving licenses (CDL where applicable), and legal authorizations to perform vehicle repairs or heavy-duty towing services in their operating jurisdictions.
  • Providers must submit to and maintain verified background checks, driving record evaluations, and certifications for all operating personnel.
  • Providers are obligated to keep all credential documentation updated within the platform, acknowledging that expired documentation results in immediate account suspension.

2. Professional Standards & Quality of Service

  • Providers agree to maintain professional conduct, proper safety attire, and compliant, road-worthy equipment (tows, service rigs, tools) at all times while performing dispatched calls.
  • Providers must accept or decline dispatched job requests within specified timeframes and provide accurate estimated times of arrival (ETAs).
  • Providers must notify both the platform and the service seeker immediately if unexpected delays or logistical complications arise during response dispatch.

3. Service Pricing & Direct Payment Model

  • Next Roadside operates strictly as a digital dispatch and connection platform and does not process, collect, or guarantee payments between service seekers and service providers.
  • Service providers are solely responsible for setting, communicating, and collecting all service fees, parts costs, labor rates, and applicable taxes directly from the service seeker on-site or via their own payment channels.
  • Next Roadside is not responsible or liable for unpaid services, customer non-payment, payment disputes, chargebacks, or bounced payments resulting from services provided through platform connections.
  • Providers agree to provide clear, upfront pricing quotes to service seekers prior to performing work to prevent payment disputes.

4. Equipment, Safety & Site Assessment Rights

  • Providers are solely responsible for maintaining and operating equipment that meets all federal, state, and provincial commercial safety regulations.
  • Service providers hold the absolute right to perform an on-site safety risk assessment upon arrival.
  • Providers are authorized to pause, delay, or refuse service if the roadside environment, traffic conditions, weather, vehicle weight/cargo, or customer behavior poses an unreasonable health, safety, or legal hazard.
  • Next Roadside shall not penalize or discipline a provider for refusing or pausing service due to verified safety hazards or illegal site conditions.

5. Insurance & Risk Requirements (Updated COI Compliance)

  • Minimum Coverage: Service providers must maintain active commercial general liability, garage keepers/hook liability, and commercial auto insurance meeting or exceeding required platform minimums.
  • Proof of Coverage: Providers must promptly supply updated Certificates of Insurance (COIs) upon renewal or policy modification.
  • Continuous Verification: Failure to maintain continuous insurance coverage or submit updated COIs leads to automatic platform removal and forfeiture of pending dispatches.

6. Indemnification & Limitation of Liability

  • Service providers operate as strict independent contractors; nothing in this agreement creates an employer-employee, agency, or joint venture relationship.
  • Providers agree to defend, indemnify, and hold harmless Next Roadside from any claims, damages, losses, or legal fees resulting from their service execution, equipment failure, negligence, or misconduct.
  • Next Roadside is not liable for provider site incidents, equipment damage, personal injuries, or secondary losses incurred while responding to or performing a service call.

7. Termination, Data Privacy & Governing Law

  • Either party may terminate the provider account with written notice, while Next Roadside retains the right to suspend or terminate accounts immediately for safety violations, fraud, or breach of terms.
  • Providers must handle user personal data (location, contact details, vehicle information) strictly for dispatch fulfillment and in accordance with privacy laws and platform privacy policy.
  • This agreement is governed by the laws of the jurisdiction where the service is executed, with all disputes subject to mandatory mediation prior to binding arbitration.

By accessing or maintaining an active profile on the Next Roadside network, providers acknowledge receipt, understanding, and acceptance of these binding terms and insurance requirements.
